statue-of-liberty serious charges

At present, we are only handling family law matters that involve the defense of a PFA.

Fight To Win.

The first impression you give the court should be that you are credible.  You should be prepared to show the court why your earnings are limited to the numbers you suggest, regardless of whether you are the support payor or payee.  You also need to show that opposing party in your case cannot hide his or her true earning capacity.

Early Victory.

You should seek victory at this stage.  Do not expect the courts to change the support obligation in the future, even though a child support obligation is “always” modifiable. Typically, in order to get an order modified, the party seeking the modification must show a material change in circumstances.

Know Your Options.

How will you prove that the other side has a certain earning capacity? Can you serve a subpoena on him or her for income information? Sometimes, yes, but usually not. Your lawyer can tell you how you can get the information you need to prove that the other side has a certain earning capacity. Otherwise, in many instances, you will be limited in the evidence you can discovery and present in the Court of Common Pleas, Family Division.
